Ian A. Cronogue is a partner at Baker, Cronogue, Tolle & Werfel, LLP in McLean, Virginia. He focuses on government contracts litigation and counseling, and also handles complex business, employment and commercial disputes.
Ian represents government contractors at every stage of the procurement lifecycle. He regularly litigates bid protests before the U.S. Court of Federal Claims and the Government Accountability Office (GAO). He represents both disappointed offerors and awardees defending their contracts as intervenors. He has briefed and argued protests involving multibillion-dollar IDIQ vehicles, GSA schedule and Alliant task orders, small-business and 8(a) set-asides, and LPTA and best-value evaluations for the Army, Navy, Air Force, Coast Guard, DHS, DLA, FDA, FEMA, GSA and VA.
Ian is a seasoned appellate and courtroom advocate. He won reversal at the U.S. Court of Appeals for the Federal Circuit of a Board of Contract Appeals decision, establishing the government's material breach of his client's contract. He has argued dispositive motions at the Court of Federal Claims, winning judgment for an awardee defending its contract, and has represented appellants before the U.S. Court of Appeals for the Fourth Circuit.
Ian also prosecutes and defends Contract Disputes Act claims before the Armed Services, Civilian and Postal Service Boards of Contract Appeals and the U.S. Court of Appeals for the Federal Circuit. His recoveries include Judgment Fund settlements on converted terminations, construction claims, requests for equitable adjustment and termination settlement proposals. His small-business practice covers SBA size and veteran-owned status protests, appeals to SBA's Office of Hearings and Appeals, mentor-protégé joint ventures, and SDVOSB and 8(a) eligibility.
Ian advises contractors facing government investigations and compliance issues. That work includes DoD Inspector General and DCIS subpoenas, suspension and debarment, voluntary disclosures, DCAA and TINA audits, and ITAR and FCPA compliance. He litigates prime-subcontractor, teaming and Miller Act disputes in federal and state court and in arbitration, and counsels clients on government contracts transactions, novations and SBIC financing.
Ian's clients range from large multinational corporations to small government contractors, including service-disabled veteran-owned, woman-owned, and 8(a) businesses and Alaska Native Corporations. His broader litigation practice includes business torts, restrictive covenants, construction, insurance, fraud, security clearance, internet defamation and stock option disputes.
